Charter Passenger Waiver and Release

1. The trip and its risks. I am going aboard a vessel on open water. I understand that this involves risks that care and seamanship cannot remove, including weather and sea state that can change quickly, a moving and wet deck, hooks, knives, gaffs and other tackle, engines and machinery, sun and heat, seasickness, and the distance from shore-based medical care. I accept those risks for myself.
2. The captain decides. The captain may shorten, move, delay or cancel the trip for weather, sea state, mechanical trouble or the safety of anyone aboard, and that decision is final while we are on the water. I will follow the captain's and crew's instructions at once, including about where to stand, when to sit and when to wear a life jacket.
3. Fitness and condition. I am able to board and be aboard, and I have told the captain before departure about any condition, medication or recent surgery that could affect my safety or anyone else's. I am not under the influence of alcohol or drugs when I board, and I understand that anyone who is may be refused.
4. Licences and regulations. I am responsible for holding any fishing licence, stamp or permit the law requires of me, and for obeying size, season and bag limits. business name will tell me what the rules are; keeping to them is mine.
5. Catch and equipment. Catch is handled and kept as the captain directs and as the law allows. I am responsible for damage I cause to the vessel or its tackle beyond ordinary use.
6. Release. To the extent the law where business name operates allows, I release business name, the vessel's owner, the captain and the crew from claims for injury, loss or damage arising from my ordinary participation, other than claims arising from their negligence or misconduct that the law does not let a release cover.
7. Medical care. If I am injured, I consent to first aid aboard and to emergency medical care ashore, and I am responsible for its cost.
8. Photographs. business name may photograph the trip and the catch for its own records. Use of my image in advertising needs my separate written agreement.
